What information do we collect about you?
Depending on whether you are a client or employee of Ourway Care Ltd will reflect on what data we require from you. This may include, but not be limited to:

Where do we collect the data from?
This data is usually collected as part of our onboarding process, from forms that you have completed and submitted to us. We may also collect data from third parties in the way of references or care plans.

Why do we require this information?
Ourway Care has a legitimate interest in holding personal data in accordance with the General Data Protection Regulation (GDPR). This is to enable Ourway Care to undertake its business activity of the provision of Health and Social Care support for individuals living in their own homes.

Who might we share your data with?
Ourway Care might share the information with people directly related with the care provision of a client, and the client themselves. Information might also be shared with service commissioners, HMRC, pension providers and the national minimum data set for social care (NMDS-SC). Limited information may also be provided to your future employers, by way of a reference.

Where do we keep this data?
This information is stored electronically within the UK (as a server backup) in an encrypted format in accordance with GDPR requirements.
All personal information you provide us remains within the UK and will not be transferred out of the EEA.

How long do we keep this information?
If you have been a client or provided services on behalf of Ourway Care; then some information would be retained for a period of up to seven years (e.g. relating to Health and Safety of the services provided to a vulnerable client or linked to HMRC) or longer if legally necessary. Other data such as your personal contact details, verified identification details and bank information may be erased after a period of two years.

Your right to access, correct or withdraw your data
At any time, you may ask to see the data Ourway Care hold about you to check its accuracy or request a copy. This can be done by completing a subject access request (SAR).
You also have the right to have the information we hold about you withdrawn, although please note that this may be subject to the requirements surrounding health and safety law and Ourway Care would be notify you if this is the case.

Data Breaches and Complaints
If Ourway Care should suspect that its’ data has been breached, we will inform the Information Complaints Office (ICO) within 72 hours of the notification of the breach.
You have the right to make a complaint at any time to the ICO. We would, however, appreciate the chance to deal with your concerns before you approach the ICO, so please contact us in the first instance.
